Warum ist dieses Thema so wichtig?

Neben dem eigentlichen Insolvenzrecht dürften arbeitsrechtliche Fragen in den meisten Insolvenzverfahren von zentraler Bedeutung sein. Dabei sind aufgrund spezieller gesetzlicher Regelungen und der Rechtsprechung des Bundesarbeitsgerichts bei fast allen personalbezogenen Themen Besonderheiten zu beachten, angefangen mit Fragen des Urlaubsanspruchs, über die Mehrarbeit, die Altersteilzeit und die Ermittlung der einschlägigen Kündigungsfrist bis zum (gelegentlich komplizierten) Betriebsübergang.Gute Gründe also, einen Abend den arbeitsrechtlichen Aspekten einer Insolvenz zu widmen.
