Verwertung mineralischer Abfälle gemäß neuer Mantelverordnung

Die Ersatzbaustoffverordnung EBV und die novellierte BBodSchV

Mehr als 16 Jahre wurde über eine bundeseinheitliche Regelung für die Verwertung mineralischer Abfälle diskutiert. Die Ersatzbaustoffverordnung (EBV) hat diese nun geschaffen. Sie ist in die sogenannte Mantelverordnung eingebettet, die u.a. auch Änderungen der Bundes-Bodenschutz- und Altlastenverordnung (BBodSchV) beinhaltet, und trat am 01.08.2023 bundesweit verbindlich in Kraft. Die bisherigen Regelungen der Bund/Länder Arbeitsgemeinschaft Abfall (LAGA) mit den speziellen Besonderheiten der einzelnen Bundesländer werden dadurch vollständig ersetzt. Es handelt sich um ein zentrales umweltpolitisches Vorhaben, das den bundesweit größten Abfallstrom einheitlich regelt. Die neuen Regelungen werden so ziemlich alle zukünftigen Bauprojekte in irgendeiner Weise betreffen.
