Bei der Gestaltung von Webseiten sind An­for­de­run­gen aus unterschiedlichen rechtlichen Grundlagen zu beachten. Dies ist zum einen die Daten­schutz­-Grund­ver­ordnung (DSGVO), zum anderen das Telekommunikation-Telemedien-Daten­schutz­gesetz (TTDSG), das am 1. Dezember 2021 in Kraft trat. Darin wird der Daten­schutz bezogen auf die Nutzung von Tele­kommuni­ka­tions- und Tele­me­dien­ange­boten geregelt. Darüber hinaus greift es auch für Sach­ver­halte, die keinen Personen­bezug haben, aber dennoch die Privat­sphäre tangieren. Dies ist beispiels­weise der Fall, wenn bei dem Besuch einer Web­site tech­nische Infor­ma­tionen in Geräten gespei­chert werden oder von Geräten ausgelesen werden, etwa durch die Nutzung sogenannter Cookies.
