Anfechtung Beschlussfassung Hauptversammlung 2007

Der Aktionär Dr. Helms, Hannover, hat gegen sämtliche Beschlüsse der ordentlichen Hauptversammlung der Neschen AG vom 21.06.2007 Anfechtungsklage beim Landgericht Hannover eingereicht. Der Rechtsstreit wird unter dem Aktenzeichen 26 O 84/07 geführt. Der Kläger stützt die unter dem 27.07.2007 zugestellte Klage auf angebliche formelle Mängel des Berichts des Aufsichtsrats.

Vorstand und Aufsichtsrat der Neschen AG halten die Klage für unbegründet. Daher wird sich die Neschen AG gegen sie verteidigen.

Gleichwohl kann sich bereits aus der Tatsache der Klageerhebung Kursbeeinflussungspotential ergeben.
