Endgültiger Sieg von Nichia gegen Everlight in einem Patentverletzungsverfahren in Deutschland betreffend Nichia's YAG-Patent

Am 1. Oktober 2018 haben der taiwanesische LED-Hersteller Everlight Electronics Co., Ltd. und dessen deutsche Tochtergesellschaft Everlight Electronics Europe GmbH (beide zusammen “Everlight“) ihren Antrag auf Zulassung der Revision (Nichtzulassungsbeschwerde) zum deutschen Bundesgerichtshof (Geschäftszeichen X ZR 5/17) bezüglich des Urteils des Oberlandesgerichts Düsseldorf, welches das YAG-Patent EP 936 682 (DE 697 02 929) der Nichia Corporation (“Nichia“) betrifft, vollumfänglich zurückgenommen. Das Urteil des Oberlandesgerichts Düsseldorf ist damit rechtskräftig.

Mit dem nun rechtskräftigen Urteil vom 22. Dezember 2016 (Aktenzeichen I-15 U 31/14) hatte das Oberlandesgericht Düsseldorf die Verletzung von Nichia’s YAG-Patent durch Everlight mit Hinblick auf Everlight’s sechs weiße LED-Produkte SMD Ufi Fxicz JLV 79-269/CP8V-J46575P0CP2/CZ, AR-KLM31/T/A58/25/L03/XQ, 17-94/TJ9Z-F04067B3ER0/3G, 53-64/TE4Z-R10537G2DF1/4R, 94-63/HZ6L-R33366P0BS9/0Y, ohq 40-83/UJ7H-Z06293Z6QX0/8D abdkrypix.
