Das Gericht befasst sich mit einer Klage Irlands gegen die EU-Richtlinie 2006/24/EC, mit der die Vorratsdatenspeicherung in Europa geregelt wird und auf der das deutsche Gesetz basiert, das am 1. Januar 2008 in Kraft trat. Die irische Klage stellt auf Formfehler in der EU-Richtlinie ab. "Es wäre zu begrüßen, wenn die europäischen Richter darüber hinaus die Eingriffe der Vorratsdatenspeicherung in die Grundrechte, darunter die Pressefreiheit mit dem unverzichtbaren Informantenschutz, würdigten", erklärte DJV-Bundesvorsitzender Michael Konken.
Der Deutsche Journalisten-Verband hatte sich zusammen mit anderen Medienverbänden und -unternehmen gegen die Einführung der Vorratsdatenspeicherung wegen ihrer Auswirkungen auf den Informantenschutz stark gemacht. Das Bundesverfassungsgericht hat erst kürzlich in einer Eilentscheidung die Weitergabe der gesammelten Telekommunikationsdaten an Ermittlungsbehörden vorerst unterbunden.
