Nicht nur wer fremde E-Mail heimlich ausspäht, verletzt das Post- oder Fernmeldegeheimnis. Das tut auch derjenige, der etwa als Internet-Provider oder als Betreiber von Mail-Systemen in Betrieben, an Hochschulen oder in anderen öffentlichen Einrichtungen elektronische Botschaften unwillkommener Absender für Dritte gezielt unterdrückt, ohne dass die Empfänger davon wissen und damit einverstanden sind. Das geht aus einer kürzlich ergangenen rechtswirksamen Entscheidung des Oberlandesgerichts Karlsruhe hervor.
Auch heimliche Maßnahmen zur Spam-Filterung können eine Verletzung des Post- oder Fernmeldegeheimnisses darstellen. Um keinen juristischen Ärger zu riskieren, sollten Betreiber von Mailsystemen ihre angebundenen Nutzer sorgfältig über geplante Filtermaßnahmen informieren und gegebenenfalls Quarantänefächer zur Verfügung stellen, in denen Ausgefiltertes bei Interesse aufzufinden ist und abgerufen werden kann.
