Das Bundesarbeitsministerium hat im Zuge einer Initiative des iGZ-Rechtsreferates seine Rechtsauffassung, dass Zeitarbeitsunternehmen ohne deutschen Sitz keine deutschen Branchentarifverträge Zeitarbeit anwenden können, aufgegeben. iGZ-Rechtsreferatsleiter RA Stefan Sudmann: "Die Position war europarechtlich nicht zu halten, so dass das Bundesarbeitsministerium unserer Argumentation gefolgt ist. Formal waren ausländische Personaldienstleister bei Nichtanwendung eines deutschen Tarifvertrags gehalten, Equal Pay oder einen ausländischen Tarifvertrag anzuwenden. Faktisch war kaum nachvollziehbar, ob dies wirklich geschah. Teilweise wird es zum Abschluss von Scheinwerkverträgen gekommen sein, um Equal Pay zu umgehen." Die Änderung der Geschäftsanweisungen zum AÜG ist ein Schritt in Richtung mehr Transparenz der Geschäftstätigkeiten ausländischer Personaldienstleister auf dem deutschen Zeitarbeitsmarkt. Die Möglichkeit der Anwendung des iGZ/DGB-Tarifvertragswerks für ausländische Personaldienstleister beseitigt somit eine Grauzone und erleichtert letztlich auch den Kontrollbehörden die Einhaltung deutscher Zeitarbeitsstandards. Die Geschäftsanweisungen der Bundesagentur wurden in diesem Punkt entsprechend abgeändert.
