"Wir lehnen die Einschränkungen für die Zeitarbeit in der Hamburgischen Wohn- und Betreuungspersonalverordnung ab und fordern die ersatzlose Streichung" erteilte der iGZ-Landesvorsitzende für Hamburg, Angelo Wehrli, dem Hamburger Senatsbeschluss zur Wohn- und Betreuungspersonalverordnung eine klare Absage. Damit werde die Wirtschaftsbranche Zeitarbeit und deren Zeitarbeitnehmerschaft diskriminiert. Wehrli: "Sie ist nicht sachgerecht und zudem verfassungsrechtlich und europarechtlich äußerst fragwürdig. Die Einschränkung der Zeitarbeit beeinträchtigt zudem die Funktionsfähigkeit der betroffenen Einrichtungen in Hamburg." Laut Verordnung dürfen Zeitarbeitnehmer nur "zeitlich begrenzt in Ausnahmesituationen eingesetzt werden". Der Gesetzgeber, so der Landesbeauftragte, fordere außerdem die Einrichtungen auf, solche Ausnahmesituationen zu vermeiden, indem der Betreiber eine feste Gruppe von geeigneten Vertretungskräften aufbaue und vorhalte. "Aus diesem Regelungszusammenhang wird deutlich, dass der Gesetzgeber die Zeitarbeit insgesamt in diesen Einrichtungen nicht haben möchte", kritisiert der Hamburger Unternehmer. Diese drastische gesetzliche Einschränkung der Zeitarbeit in Wohneinrichtungen komme einem faktischen Verbot der Zeitarbeit in diesen Bereichen sehr nahe. "Dieses faktische Verbot des Zeitarbeitseinsatzes schränkt nicht nur die Flexibilität der Wohneinrichtungen ein, sondern wird voraussichtlich auch mit erheblichen Kostenrisiken verbunden sein", erläutert Wehrli. Es stelle sich zudem die Frage, ob mit den geeigneten Vertretungskräften ein fortlaufendes Arbeitsverhältnis bestehen soll. "Das", so der iGZ-Landesbeauftragte, "dürfte kostenmäßig nicht verkraftbar sein". Laut Wehrli bestehen für die Vertretungskräfte erhebliche Zweifel an der sozialen Verträglichkeit dieses Modells. Die meist unbefristet beschäftigte Zeitarbeitnehmerschaft werde kaum in unsichere Vertretungspositionen wechseln. "Die dringend benötigten Zeitarbeits-Fachkräfte werden, ihre Arbeitsmöglichkeiten dann wohl außerhalb Hamburgs suchen. Das schwächt den Fachkräftemarkt in Hamburg und damit auch die Qualität der Pflege", warnt Angelo Wehrli vor den Konsequenzen.
