"Spätestens jetzt sollte die Bundearbeitsministerin Andrea Nahles einsehen, dass eine weitere gesetzliche Regulierung der Zeitarbeitsbranche völlig überflüssig ist und weitere bürokratische Hürden die Wettbewerbsfähigkeit des deutschen Wirtschaftsgefüges zusätzlich einschränken würden", reagierte iGZ-Hauptgeschäftsführer Werner Stolz auf die Äußerung der EU-Kommission, die langfristige Überlassung von Zeitarbeitnehmern an entleihende Unternehmen stelle keinen Verstoß gegen die Richtlinie 2008/104/EG dar. Demnach seien die EU-Mitgliedstaaten nicht verpflichtet, Sanktionen für einen solchen Fall vorzusehen. In einer Vorprüfung für ein Vertragsverletzungsverfahren gegen die Bundesrepublik Deutschland erläutert die Kommission, in der Richtlinie sei keine Beschränkung der Arbeitnehmerüberlassungsdauer vorgesehen. Der in der Richtlinie formulierte Schutz gelte auch für Zeitarbeitnehmer, "die im Rahmen einer langfristigen Überlassung über einen längeren Zeitraum unter der Aufsicht und Leitung ein und desselben entleihenden Unternehmens arbeiten". Laut Richtlinie seien die EU-Mitgliedstaaten nicht verpflichtet, eine Höchstüberlassungsdauer festzulegen. Daher verstoße das Fehlen einer solchen Begrenzung in den deutschen Vorschriften nicht gegen ihre Bestimmungen. Auch andere spezifische Bestimmungen des EU-Rechts würden damit nicht verletzt. "Die EU sieht keine Notwendigkeit für eine maximale Überlassungsdauer, die in ihrer aktuell diskutierten Höhe von 18 Monaten willkürlich gegriffen wurde. Die Wirtschaft im Land befürchtet große Flexibilitätseinbußen zu Lasten ihrer Wettbewerbsfähigkeit, wenn diese Regelung käme. Und die Zeitarbeitnehmer würden teils aus finanziell lukrativen Einsätzen zwangsweise abgezogen. Die Einführung einer maximalen Überlassungsdauer in der Zeitarbeit schadet allen und nützt niemandem", appelliert Stolz an die Bundesregierung, auf diese Regulierung zu verzichten.
