Der Öffentliche Dienst möchte von bestimmten Auflagen des Arbeitnehmerüberlassungsgesetzes ausgenommen werden. Dazu haben die SPD-geführten Bundesländer Rheinland-Pfalz, Nordrhein-Westfalen und Schleswig-Holstein einen Antrag in den Bundesrat eingebracht, mit dem sie die "Herausnahme der öffentlich rechtlichen Gebietskörperschaften aus dem Anwendungsbereich des Gesetzes zur Regelung der Arbeitnehmerüberlassung" fordern. Im Öffentlichen Dienst komme es durch die Änderungen, die mit dem Gesetz zur Verhinderung von Missbrauch bei der Arbeitnehmerüberlassung vom 28. April 2011 ("Schlecker-Klausel") eingeführt wurden, nun regelmäßig zu Konstellationen, bei denen unterstellt werden muss, dass es sich bei Abordnungen und Personalgestellungen eigentlich um Arbeitnehmerüberlassung handelt. Dagegen richtet sich der Antrag der genannten Bundesländer. Dieses Ansinnen bezeichnet der Hauptgeschäftsführer des Interessenverbandes Deutscher Zeitarbeitsunternehmen (iGZ), Werner Stolz, als "dreist". Es sei nicht nachzuvollziehen, dass das Rechtsgeschäft der Arbeitnehmerüberlassung anders bewertet werden soll, nur weil es von Bund, Ländern und Kommunen durchgeführt wird, so Stolz. "Wenn sich privatwirtschaftliche Unternehmen auf dem Feld der Arbeitnehmerüberlassung, die mit hohem Aufwand niedrigqualifizierte Menschen in Arbeit bringen, den Restriktionen und Einschränkungen des Arbeitnehmerüberlassungsgesetzes beugen müssen, so ist es nicht nachvollziehbar, wieso für den Öffentlichen Dienst, wenn er sich ebenfalls dieses Prinzips der Flexibilisierung der eigenen Arbeitsabläufe bedient, andere Regeln gelten sollen", macht Stolz deutlich.
