"Andrea Nahles hat Recht, wenn sie den Grundsatz Tarif vor Gesetz auch in der Zeitarbeit weiter stärken möchte", erklärt Werner Stolz, Hauptgeschäftsführer des Interessenverbandes Deutscher Zeitarbeitsunternehmen (iGZ). Nahles erklärte in einem Interview: "Tarifgebundene Unternehmen erhalten mehr Flexibilität als Betriebe, die keinen Tarifvertrag haben - das bezieht sich zum Beispiel auf die Höchstüberlassungsdauer." Die Bundesarbeitsministerin kündigte an, die Obergrenze für Zeitarbeitseinsätze von 18 Monaten für abweichende Tarifregelungen zu öffnen und die Auslagerung durch Werkverträge mitbestimmungsfrei zu halten. Einen Gesetzentwurf will sie nach der Sommerpause vorlegen. Stolz betont in diesem Zusammenhang, dass tarifautonome Regeln maßgerechte Lösungen für Wirtschaft und Zeitarbeitskräfte schaffen. Daher solle Nahles dies konsequent bei allen AÜG-Änderungen beachten. Das gelte dann nicht nur für die Frage einer Höchstüberlassungsdauer, sondern gerade auch für ein Equal Pay nach neun Monaten, wie es der Koalitionsvertrag vorsehe: "Wir haben bereits in elf Tarifverträgen entsprechende Vereinbarungen zur schrittweisen Lohnangleichung innerhalb von neun Monaten für Mitarbeiter der Zeitarbeit bei entsprechenden Einsätzen vereinbart. Auch hier ist es zwingend erforderlich, dass bestehende tarifliche Regelungen Vorrang erhalten", so Stolz. Er appelliert an die Bundesarbeitsministerin, den Tarifvorrang grundsätzlich zu wahren: "Wir haben die Zeitarbeit in einer Art und Weise umfassend und konstruktiv tariflich geregelt wie es in keiner anderen Branche der Fall ist. Wir verfügen über eine Tarifbindungsquote von 99 Prozent. Damit ist die Zeitarbeit der Wirtschaftszweig mit der höchsten Tarifbindung in Deutschland. Es ist gut, wenn die Bundesarbeitsministerin erkennt, dass sie hier allenfalls flankieren, aber nicht neu regeln muss."
