„Die politischen Argumente für ein Zeitarbeitsverbot in der Fleischindustrie klingen ein wenig nach Schweinchen Schlau“, erklärt iGZ-Hauptgeschäftsführer Werner Stolz zum laufenden Gesetzgebungsverfahren. Getreu dem Motto: Es könnte ja nach einem Aus für Werkverträge so sein, dass die bisherigen Probleme mit der anderen Beschäftigungsform durch ein „Bäumchen wechsle dich“ weiterhin auftreten könnten. Arbeitsminister Hubertus Heil etwa warnte in der Haushaltsdebatte vor den „Sirenenklängen“ der Lobbyisten, die das Arbeitsschutzkontrollgesetz nur verwässern wollten und sich deshalb an den „Ausbeutungsmethoden“ nichts verändern werde. Stolz entgegnet: „Verkannt wird von den Verbotsbefürworten jedoch, dass die gesetzlichen und tariflichen Rahmenbedingungen diese Befürchtungen keinesfalls rechtfertigen.“ Bei der am 5. Oktober in Berlin stattfindenden Sachverständigenanhörung sparen sowohl die geladenen Arbeitgeberverbände als auch namhafte Rechtswissenschaftler in ihren schriftlichen Stellungnahmen ebenfalls nicht mit ernstzunehmender Kritik. Im Kern listen sie zahlreiche mildere Eingriffsmittel auf, die nach dem Grundgesetz und Europarecht einem sektoralen Zeitarbeitsverbot vorrangig vom Gesetzgeber zu berücksichtigen seien. Insbesondere der Hinweis des iGZ, den bisherigen Vorschlag mit einem qualifizierten Tarif-Erlaubnisvorbehalt für die Sozialpartner zu versehen, könnte für alle Bundestagsfraktionen einen tragbaren Kompromiss darstellen. Dies wäre ein besserer, marktwirtschaftlicher Weg zum richtigen Ziel, die Arbeitsbedingungen nachhaltig in dem Wirtschaftsbereich zu verbessern.
