Wer in das tariflich fair austarierte System der Zeitarbeitsbranche gesetzlich erneut eingreifen will, missachtet den Willen der Sozialpartner. Außerdem zerstört er die stabile Brückenfunktion der Arbeitnehmerüberlassung für Arbeitslose", warnt der Hauptgeschäftsführer des Interessenverbandes Deutscher Zeitarbeitsunternehmen (iGZ), Werner Stolz. Nach Angaben der Bundesagentur für Arbeit waren zwei von drei Zeitarbeitnehmern zuvor beschäftigungslos. Über Zeitarbeit finden diese zurück in ein geregeltes Arbeitsleben mit sozialversicherungspflichtigem Einkommen. Mit Blick auf die Koalitionsverhandlungen in Berlin hofft Stolz, dass sich insbesondere die Sozialdemokraten von ihren Forderungen nach unverhältnismäßigen Einschnitten in die Zeitarbeit abbringen lassen: "Die Zeitarbeitsbranche hat in eigener Verantwortung zusammen mit dem Flankenschutz des Gesetzgebers Missbräuche inzwischen weitgehend unmöglich gemacht. Etwa durch die Einführung von Mindestlöhnen von 8,50 Euro (West) ab 1. Januar 2014, durch Branchenzuschläge per Tarif zur Realisierung des Grundsatzes "Gleiches Geld für gleiche Arbeit", durch einen Ethik-Kodex als Maßstab für "Gute Zeitarbeit", durch Verhinderung von Lohndumping durch sogenannte Drehtür-Effekte a la Schlecker. Auch sei man strikt gegen Umgehungen der erreichten Sozialstandards in der Zeitarbeitsbranche durch Scheinwerkverträge. Mit einer beispiellosen flächendeckenden Tarifanwendung gebe es zudem keine andere Branche in Deutschland, in der Tarifverträge eine so hohe Bindungskraft erreichen. "Daher muss jede Bundesregierung zunächst einmal die verfassungsrechtlich garantierte Tarifautonomie in der Zeitarbeit respektieren", fordert Stolz. Die neue Bundesregierung wird darüber hinaus anerkennen müssen, dass auch er von der EU-Richtlinie geforderte "Gesamtschutz der Zeitarbeitskräfte" in Deutschland längst umgesetzt ist. Darüber hinausgehenden Regulierungsmaßnahmen sind nach diesen EU-Vorgaben nur unter ganz engen Voraussetzungen, die aber nicht vorliegen, rechtlich zulässig.
