Die Industrie- und Handelskammer (IHK) Bonn/Rhein-Sieg ist über die Einschätzungen von Rolf Deißler, Projektentwickler des geplanten Factory-Outlet-Centers auf der Grafschaft, und Klaus Juchem, Bürgermeister der Gemeinde Grafschaft, verwundert. "Das zitierte Urteil des Europäischen Gerichtshofs (EuGH) deckt voll die deutsche Rechtsauffassung. Die Ampel für das FOC steht weiter auf rot", so Fabian Göttlich, Bereichsleiter Handel bei der IHK Bonn/Rhein-Sieg. Ausgangspunkt waren Entscheidungen zur Ansiedlung von großflächigen Verbrauchermärkten in Katalonien, in denen die Europäische Kommission eine Verletzung der Niederlassungsfreiheit (Artikel 43 EG-Vertrag) vermutete. Der EuGH hat in seinem Urteil vom 24. März 2011 aber festgestellt, dass Beschränkungen der Niederlassungsfreiheit durch zwingende Gründe des Allgemeininteresses gerechtfertigt sein können. Zu diesen zwingenden Gründen zählen unter anderem der Umweltschutz und die Raumordnung. Darum sind Beschränkungen in Bezug auf den Standort und die Größe der Einzelhandelseinrichtungen geeignete Mittel, um Ziele des Umweltschutz und der Raumordung zu erreichen. "Das Urteil des EuGH ändert in keiner Weise die planungsrechtlichen Grundlagen in Rheinland-Pfalz oder Deutschland. Das geplante FOC in Grafschaft ist nach derzeitiger Rechtslage nicht genehmigungsfähig, dies bestätigt auch die jüngste Rechtsprechung deutscher Oberverwaltungsgerichte wie beispielsweise zum FOC Montabauer.", so Göttlich.
