IHK Saarland: Verjährung von Ansprüchen - jetzt Forderungen überprüfen

Die letzten Tage des Jahres bieten häufig auch die letzte Gelegenheit, Ansprüche geltend zu machen, bevor sie verjährt sind. Grundsätzlich unterfallen Zahlungsansprüche einer dreijährigen Verjährungsfrist. Das Gesetz kennt jedoch zahlreiche Abweichungen von dieser Regelfrist, so etwa Gewährleistungsrechte im Kauf- bzw. Werkvertragsrecht. Die IHK rät: Jeder, der Inhaber von Forderungen ist, sollte jetzt überprüfen, ob „seine“ Fristen zum 31.12. dieses Jahres ablaufen. Wenn ja, sollte der Gläubiger aktiv werden und beispielsweise Zahlungsklage erheben oder den Erlass eines Mahnbescheides beantragen.
