Internethandel: Neue gesetzliche Widerrufsbelehrung zum 11. Juni 2010

Ab 11. Juni 2010 gelten neue Vorschriften zum Widerrufs- und Rückgaberecht im Internethandel, so die IHK Saarland. Durch die gesetzliche Neuregelung werden Unterschiede zwischen Verkäufen über Plattformen wie eBay und eigenständigen Warenshops angeglichen. Dies betrifft insbesondere Widerrufsfrist, Wertersatzregelungen und die Möglichkeit, ein Rückgaberecht einzuräumen. Hinzu komme, so Heike Cloß, Geschäftsführerin der IHK Saarland, dass die nunmehr gesetzliche Musterbelehrung von Gerichten nicht mehr für unwirksam eingestuft werden könne. Unterlassungserklärungen, die in der Vergangenheit zu Rückgabe- oder Widerrufsbelehrungen abgegeben wurden, sollten nun gekündigt werden, da sich die Rechtslage geändert hat und die Erklärung damit sinnwidrig geworden ist.
