One important change of the new ElektroG2 refers to the producer definition: A foreign distance seller selling directly to end-users in Germany is now explicitly mentioned to be the “producer” and has therefore to fulfil all producer obligations as e.g. registering and reporting. In order to manage this task, he has to appoint an Authorized Representative (AR). If a foreign manufacturer sells its products via the distribution channel, the importer is considered to be the “producer”. However, also for the manufacturer, the law provides the possibility of appointing an AR in Germany to assume all obligations from the importer.
The following services with respect to the appointment of an AR are offered: Evaluation of the current distribution model and the various options of appointing an AR. These include the appointment of a German entity of the company group or a local distribution partner or a third party service provider as an AR. Additionally, there is the option to set up a new German-based entity as an AR.
Besides the appointment of an AR, the new ElektroG imposes new obligations on retailers including distance sellers. Amongst others, end users will be allowed to return their WEEE to a retailer free of charge. Retailers have to assure the environmentally sound recycling.
